Analisis Pertimbangan Hakim Terhadap Putusan Cerai Seorang Istri Dalam Keadaan Hamil

Abstract
Marriage fundamentally aims to adhere to religious guidance in building a harmonious family. However, issues within households often lead to separation or divorce. Divorce can also occur when the wife is pregnant, as in the case of a husband and wife where the pregnant wife files for divorce in the Religious Court (Case No. 541/Pdt.G/2016/PA.Bkl). This research examines the judge's considerations regarding the divorce decision of a pregnant wife. Focusing on Islamic Law perspective, a wife seeking divorce must provide compensation to her husband and file for divorce in the Religious Court. If the husband refuses divorce, the judge can decide on divorce after a trial. However, cases of pure Khulu’ are rare in the Religious Court. The decision is deemed lawful as it complies with regulations governing disputes, the nature of conflicts, and the impossibility of peaceful coexistence between spouses within the household, in accordance with Article 22 of Government Regulation No. 9 of 1975 and Article 76 of Law No. 7 of 1989. This research utilizes a library research approach and employs a descriptive-analytical method for analysis. The findings indicate that Decision No. 541/Pdt.G/2016/PA.Bkl is legally sound, meeting the criteria outlined in Article 22 of Government Regulation No. 9 of 1975 and Article 76 of Law No. 7 of 1989. Divorce cases can be granted when the court sufficiently discerns: the causes of disputes and conflicts, the nature and form, the degree of discord, and upon consideration, determines that it significantly affects the fundamental well-being of the spouses, with no hope for peaceful coexistence within the household.
Abstrak
Perkawinan pada dasarnya mempunyai tujuan untuk memenuhi petunjuk agama untuk membangun keluarga yang harmonis. Namun sering dijumpai permasalahan dalam rumah tangga yang menyebabkan ternyadinya perpisahan atau perceraian. Perceraian pun juga bisa terjadi dikala istri yang sedang hamil, seperti halnya pada pasangan suami istri yang mana istri dalam keadaan hamil menggugat suaminya kepada Pengadilan Agama. Penelitian ini mengulas pertimbangan hakim terhadap putusan cerai seorang istri yang sedang hamil (Putusan No. 541/Pdt.G/2016/PA.Bkl). Berfokus pada perspektif Hukum Islam, istri yang ingin bercerai harus membayar tebusan kepada suami serta mengajukan gugatan perceraian ke Pengadilan Agama. Jika suami menolak bercerai, hakim dapat memutuskan perceraian setelah pemeriksaan persidangan. Namun, kasus Khulu’ murni jarang terjadi di Pengadilan Agama. Putusan ini dinilai sesuai dengan ketentuan hukum yang mengatur perselisihan, sifat pertengkaran, dan ketidakmungkinan hidup rukun lagi bagi suami istri dalam rumah tangga, sesuai dengan Pasal 22 Peraturan Pemerintah No. 9 Tahun 1975 dan Pasal 76 Undang-Undang No. 7 Tahun 1989. Dalam penelitian ini menggunakan jenis penelitian kepustakaan (library research). Sedangkan metode analisis yang digunakan di dalam penelitian ini menggunakan teknik analisis deskriptif-analitik. Hasil penelitian menunjukkan bahwa pada putusan Nomor 541/Pdt.G/2016/PA.Bkl telah sesuai menurut hukum, sesuai ketentuan yang tertuang dalam pasal 22 Peraturan Pemerintah No. 9 Tahun 1975 dan pasal 76 Undang-Undang No. 7 Tahun 1989 perkara perceraian ini dapat dikabulkan apabila telah cukup jelas bagi pengadilan mengenai: sebab-sebab perselisihan dan pertengkaran, sifat dan bentuk serta kadar pertengkaran dan setelah dipertimbangkan ternyata benar-benar berpengaruh dan prinsipil bagi suami istri, tidak ada harapan akan hidup rukun lagi dalam rumah tangga.
